Checkstat.sh - does not remove 'mv_failed'

I spoke too soon about checkstat.sh working properly. It 
only works once, and when it generates the 'mv_failed' 
file it will not work again. It's supposed to remove this file 
if MV is running, but it doesn't. This happens on both my 
own system (RH 5.2, kernel 2.0.36-07) and my webhoster's
system (RH 4.2). If I remove the 'mv_failed' file manually then it will 
work properly and restart MV, but not otherwise. This file 
has permissions of -rw-r--r-- on my webhoster's system, 
and -rw-rw-r-- on my system ( ownership is correct). 

Apart from editing the site configuration, the only change 
I've made is to remove the '-' from '-waxu', so as to 
eliminate the ".. '-' is deprecated ...." messages.

Is this maybe an old script that no longer works with 
current versions of Minivend? Does anyone have it 
working?
