Might I suggest the following. Make the list closed. Make the subscription
e-mail clearly detail that spamming is unacceptable and that it will
incur a cost of $100 per subscribed user (or a minimum or $3000) and that
any e-mail to the list indicates acceptance of those conditions. Then
when the spammers strike, the list owner tracks them down and invoice them
for the $$$ and when they don't cough it up hand the debt over to an
appropriate debt collection agency telling the agency that they can retain
the total debt on successful recovery.

Hell I don't tolerate - I hunt them down and as a minimum get their accounts
closed and any ISP that should of known better gets an earfull.
